Terms of Service

These Terms of Service ("Terms") are a legally binding contract between you and Jack Allen Ltd, a company registered in England and Wales ("repset", "we", "us", or "our"), governing your use of the repset mobile app, website, and related services (together, the "Service"). By creating an account, accessing, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

You must be at least 16 years old to use the Service. By using repset you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

You may sign in using Google, Apple, or an email one-time code. You must provide accurate information, keep your account credentials secure, and not share your account. You are responsible for all activity that occurs under your account. Notify us promptly at support@repset.app if you suspect any unauthorised use.

repset is a fitness and workout tracking application with a social layer. It lets you track workouts using a live workout tracker, log body measurements, set and track goals, and record supplements. Social features include following other users, a feed of activity from people you follow, likes, public profiles, and finding people to follow. You can also connect optional third-party services and manage an optional paid subscription.

We may add, change, suspend, or remove features at any time. We do not guarantee that the Service, or any particular feature, will always be available, uninterrupted, or error-free.

The Service uses artificial intelligence, powered by third-party large language model providers (such as OpenAI, accessed directly or via an AI gateway), to generate workout suggestions, nutrition guidance, and responses in the AI chat assistant ("AI Content").

AI Content is generated automatically and may be inaccurate, incomplete, outdated, misleading, or unsuitable for you. It is provided for general informational and entertainment purposes only. AI Content is not professional advice of any kind, including medical, clinical, dietary, nutritional, psychological, or personal-training advice, and must not be treated as a substitute for consultation with an appropriately qualified professional who knows your individual circumstances.

You use and rely on AI Content entirely at your own risk. You are solely responsible for evaluating AI Content and for any decisions you make or actions you take based on it. Always exercise your own judgement, and seek advice from a qualified doctor, dietitian, or trainer before acting on any suggestion — particularly before starting, changing, or intensifying any exercise or nutrition programme.

We do not use your personal data or content to train, fine-tune, or otherwise develop AI or machine learning models. When your data is sent to our third-party AI providers to generate a response for you, we do so under contractual terms that prohibit those providers from using your data to train their models. Data is processed only to deliver the feature you requested.

Physical exercise carries inherent risks, including the risk of serious injury, illness, disability, or, in rare cases, death. These risks apply to any activity you undertake in connection with the Service, including workouts you track, programmes or exercises suggested by the Service or its AI, and nutrition or supplement guidance.

You should consult a physician or other qualified healthcare professional before beginning any exercise or nutrition programme, especially if you have any medical condition, injury, or concern. Stop and seek medical attention if you experience pain, dizziness, or discomfort.

By using the Service you voluntarily and knowingly assume all risks associated with physical activity, nutrition, supplementation, and any use of the Service. To the fullest extent permitted by law, repset is not liable for any injury, health outcome, loss, or damage arising from your participation in physical activity, your nutrition or supplement choices, your reliance on AI Content or any other content, or your use of the Service.

All health, fitness, nutrition, body-measurement, supplement, and wellness content in the Service — whether generated by AI, calculated by the app, or otherwise presented — is provided for general informational purposes only. It is not medical advice, diagnosis, or treatment, and it does not create any practitioner-patient or professional relationship. Never disregard or delay seeking professional medical advice because of something you have read or seen in the Service.

You may choose to connect third-party services to repset, including Strong, Strava (which may include GPS route and precise location data), Withings, and gym platforms such as GymOS and Fitbod. These connections are optional and are controlled by you; you can disconnect them at any time.

Third-party services are operated by their own providers and are governed by those providers' own terms and privacy policies. We are not responsible for third-party services, their content, the accuracy or completeness of data they provide, or their availability. Your use of a third-party service is at your own risk and between you and that provider.

You retain ownership of the workouts, measurements, goals, posts, activities, and other content you create or sync ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt, and display Your Content as necessary to operate and provide the Service, including to display it to you and to the people and users with whom the Service's features let you share it (such as your followers and viewers of your profile). This licence lasts only as long as we retain the relevant content. Deleting an activity removes it from the Service, subject to routine backups and legal retention.

You represent and warrant that you have all rights necessary to submit Your Content and that Your Content does not infringe any third party's rights or violate any law or these Terms.

You agree not to, and not to attempt to:

post or share content that is unlawful, defamatory, harassing, hateful, threatening, obscene, sexually explicit, or that infringes anyone's intellectual property or privacy; impersonate any person or misrepresent your affiliation; harass, abuse, stalk, or harm other users; upload malware or interfere with the Service; scrape, harvest, reverse engineer, overload, or gain unauthorised access to the Service or its systems; access other users' data beyond what the product intentionally shares; or use the Service in breach of any applicable law or these Terms.

The Service includes social features that let you follow other users, view their profiles and activity, and interact through likes. You are solely responsible for your interactions with other users and for the content you post.

You can block other users and report content or behaviour that breaches these Terms. While we have no obligation to monitor content or conduct, we reserve the right (but do not assume any duty) to review, remove, restrict, or disable access to any content, and to warn, suspend, restrict, or terminate any account, at our discretion and without notice, including where we consider it necessary to protect users or the Service. We are not responsible for content posted by users.

repset offers an optional paid subscription ("repset Pro") on monthly or yearly plans, which may include a free trial. Subscriptions are sold and billed through Apple via your Apple App Store account, in accordance with Apple's terms.

Subscriptions renew automatically at the then-current price for the same period unless cancelled at least 24 hours before the end of the current period. Your Apple account is charged for renewal within 24 hours before each period begins. If you take a free trial and do not cancel before it ends, it will automatically convert to a paid subscription and you will be charged. You manage and cancel your subscription, and any free trial, through your Apple App Store account settings — not through us.

Except where required by law or by Apple's policies, payments are non-refundable and there are no refunds or credits for partially used periods. Refund requests for App Store purchases are handled by Apple.

To the fullest extent permitted by law, the Service and all content (including AI Content and data from third-party services) are provided "as is" and "as available" without warranties or representations of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content or results (including AI Content) will be accurate, reliable, complete, or suitable for you.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any other liability that cannot be excluded or limited under the laws of England and Wales.

Subject to the paragraph above, and to the fullest extent permitted by law:

(a) we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, however arising, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable; and

(b) our total aggregate liability arising out of or in connection with the Service and these Terms shall not exceed the greater of (i) the total amounts you paid to us for the Service in the twelve (12) months immediately before the event giving rise to the liability, or (ii) ten pounds sterling (£10).

You acknowledge that the Service is not a substitute for professional advice and that we are not liable for decisions you make based on the Service or any content within it.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Jack Allen Ltd and its directors, officers, employees, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with your use or misuse of the Service, Your Content, your breach of these Terms, or your violation of any law or of any third party's rights.

You may stop using the Service at any time and request account deletion by emailing support@repset.app. We may suspend, restrict, or terminate your access to the Service, in whole or in part, at any time — with or without notice — if you breach these Terms, if we are required to by law, or if we reasonably consider it necessary to protect the Service or other users. Sections that by their nature should survive termination (including content licences already granted, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply.

We may update these Terms as the Service evolves. When we do, we will change the effective date above and, where changes are material, take reasonable steps to notify you in the app. Changes take effect when posted unless stated otherwise. If you continue to use the Service after changes take effect, you accept the updated Terms.

Governing law and jurisdiction. These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer you may also benefit from mandatory protections of the country in which you live.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements. Apple is not a party to these Terms and is not responsible for the Service.
